		<description>Unfortunately, once a debt has been passed to an attorney and this is a confirmed legal threat, then they want the payment in full (or very close to it) up front. They really don&#039;t want to do 50% settlements at this point. They are not obligated to take any settlement at this point. Honestly, you probably could have settled for 50% prior to the account being turned over to an attorney.
- How large is this debt? The conventional wisdom is that $10,000 is the minimum amount that anyone should consider filing for Chapter 7. Filing for Chapter 7 is not free and it will cost $2,000 on average.
If this debt is huge and beyond your ability to pay, then maybe Chapter 7 is needed.
- There is no need to spend $300/hour hiring an attorney to try to negotiate a settlement...you&#039;d be better off saving the money and adding that amount to whatever you can afford to settle. They&#039;ll either accept it or they won&#039;t. If they don&#039;t and they do take you to court, then it&#039;s critical that you show up in court.

If you have 50% and they won&#039;t take it then screw them, make them follow through. What else can you do? In my mind the total amount owed would make a big difference in whether I would file bankrupcy or not. (also your financial situation). Moving forward if you have the ability to pay and its less than $20k I would probably not file bankrupcy. If its more than that i most certainly would suck it up and do the BK.
                   Besides even if you go to court and are found to owe the entire amount (which you will). You can arrange a settlement agreement with them (YOU MUST honor this agreement and never miss a payment or they have the right to collect the entire rest of amount owed right then and there and can attach your checking account etc..). they also depending on the state may have the right to garnish your wages (go through your employer to have money taken out of your check before you receive any of your check).
